1. AGREEMENT TO TERMS OF USE

(j) Ownership and Risk
Once your order leaves our warehouse and is handed over to a carrier, ownership and responsibility for the package are transferred to you. For larger items sent via freight, the transfer of risk happens at the time the product departs our facility. We are not responsible for delays or damage caused during transit.
(k) Shipping Policy
Orders are shipped only within eligible locations in the U.S. Delivery timelines provided at checkout are estimates and not guarantees. Once submitted, the delivery address on your order cannot be changed. Some items may ship separately or directly from a third-party supplier. We are not responsible for delays beyond our control, such as weather, carrier issues, or manufacturer shortages.
(l) Returns
Eligible products may be returned within 30 days of delivery, as long as they are unused and in original condition with all packaging intact. (m) Product Exchanges
If you need to exchange a qualifying product for a different item, you may do so within 30 days of receiving your order. If the replacement item costs more, you’ll need to cover the price difference. If it costs less, we’ll refund the remaining amount. If you later return the exchanged item, a restocking fee of 20% may apply, deducted from your refund.

This limited-time promotion applies only to qualifying bathroom remodeling projects scheduled between May 1, 2025 and May 31, 2025. The 60% discount applies to the lower-priced of the two bathrooms included in the same contract and service period. Eligibility for this offer is determined solely by Us, and not all bathroom types or configurations may qualify. The offer may be subject to additional limitations based on the scope of work, materials selected, and project complexity. This promotion cannot be combined with other offers, discounts, or incentives, and has no cash value. We reserves the right to modify or discontinue this promotion at any time without prior notice.

If no payment was made by you for the service or product in question, then, to the extent allowed by law, your sole remedy will be limited to seeking non-monetary (injunctive) relief. Under such circumstances, you agree not to pursue any monetary damages.
This limitation does not apply where the law does not permit exclusions, including (i) cases involving death or personal injury caused by intentional misconduct, (ii) fraud or deliberate deception, or (iii) any other type of liability that cannot legally be waived or restricted.
14. LEGAL JURISDICTION AND APPLICABLE LAW
Your use of this website and any services offered through it will be governed by the laws of the State of New Hampshire, excluding any rules that might apply the laws of another jurisdiction.
If any disagreement or legal issue arises from your use of the site or these Terms, both you and Pic Home Pros agree that such matters must be handled exclusively in the appropriate state or federal courts located in New Hampshire. By using this site, you consent to the authority of those courts and waive any right to dispute that venue.

15. ARBITRATION AGREEMENT AND DISPUTE RESOLUTION
(a) Please Review Carefully. This section outlines the binding arbitration agreement between you and Pic Home Pros and has a direct impact on your legal rights. It includes important information regarding mandatory arbitration and a waiver of the right to bring claims as part of a class or collective action.
(b) Scope of Agreement. By using this website or any services provided by Pic Home Pros, you agree that any dispute, controversy, or claim related to your use of the services, your relationship with us, or any aspect of this Agreement shall be resolved exclusively through final and binding arbitration, and not in court. However, you may pursue an individual claim in small claims court if it meets the relevant jurisdictional requirements, and either party may seek injunctive or equitable relief in court in matters involving intellectual property rights, including but not limited to trademarks, copyrights, trade secrets, or patents.
This arbitration provision applies to all disputes and claims, whether arising under this Agreement or any prior interactions with us. You understand and agree that by entering into this agreement, you are waiving the right to participate in any class, collective, or representative action. If you wish to pursue a claim, it must be done on an individual basis through arbitration.
(c) Arbitration Procedure. Any arbitration shall be conducted in accordance with the rules and procedures of a reputable arbitration service provider such as JAMS or another mutually agreed-upon forum. The arbitration shall take place in the State of New Hampshire, and the proceedings will be governed by the applicable rules in effect at the time the arbitration is initiated. Unless otherwise agreed, the arbitration shall be presided over by a single arbitrator. The decision of the arbitrator will be final and binding, and judgment may be entered in any court of competent jurisdiction.
Pic Home Pros will reimburse arbitration filing fees for claims under $10,000 unless the arbitrator determines the claim is frivolous. Additionally, we will not seek attorney’s fees or costs in arbitration unless the arbitrator finds the claim to be brought in bad faith.
(d) Authority of the Arbitrator. The arbitrator shall have the exclusive authority to interpret and enforce the terms of this Arbitration Agreement, including the determination of its scope, validity, and enforceability. The arbitrator may award any relief available under applicable law on an individual basis, including monetary damages or injunctive relief. All proceedings shall remain individual and shall not be consolidated with other claims or parties. The arbitrator will issue a written decision explaining the findings and rationale supporting the award.
(e) Waiver of Court Proceedings. YOU AND PIC HOME PROS EXPRESSLY WAIVE THE RIGHT TO A JURY TRIAL. You acknowledge and agree that arbitration is the exclusive forum for dispute resolution under this Agreement. While the arbitrator may grant similar remedies as a court could, arbitration proceedings are not overseen by a judge or jury, and judicial review is limited.
(f) No Class Actions. All claims must be brought in an individual capacity and not as a plaintiff or class member in any purported class, collective, or representative proceeding. If a court or arbitrator determines that this class action waiver is unenforceable with respect to any particular claim, that claim must be resolved in court and not in arbitration. All remaining claims subject to arbitration will proceed individually.
(g) Right to Opt Out. You have the right to opt out of this Arbitration Agreement within thirty (30) days of first becoming subject to it. To do so, you must send a written notice clearly stating your intention to opt out. The notice must include your full name, address, and email address associated with your interactions with Pic Home Pros, and must be mailed to:

Please note: Opting out of this arbitration provision will not affect any other terms of the Terms of Use or agreements you have with Pic Home Pros.
(h) Legal Venue for Court Actions. To the extent a claim is permitted to be heard in court rather than through arbitration, you agree that any such legal action will be brought exclusively in the state or federal courts located in the State of New Hampshire. You consent to the personal jurisdiction and venue of those courts for such purposes.
16. INDEMNIFICATION
By accessing and using the services offered through Pichomepros.com, you agree to take responsibility for your actions and to protect and compensate Pichomepros.com, along with its affiliates, parent company, officers, directors, employees, agents, contractors, and partners, from any claims, damages, losses, liabilities, or expenses, including reasonable attorneys’ fees, that may arise as a result of: (a) your use or misuse of the site or its services; (b) any violation of these Terms of Use; or (c) any materials or content you submit or transmit through the site.

17. SURVIVAL
The provisions outlined in Sections 4 and 7 through 17 shall remain in full force and effect even after the termination or expiration of these Terms. These surviving terms continue to apply to matters arising prior to termination and to obligations that, by their nature, are intended to survive.
